Terms & Conditions

§1 Scope of Application
These Terms and Conditions apply to all services offered by Marco Störmer (freelance graphic and digital designer) through this website, in particular branding, rebranding, web design, and digital product design. They apply both to consumers and entrepreneurs, unless a specific clause states otherwise. Conflicting client terms do not apply unless expressly confirmed by me in writing.
§2 Offer and Conclusion of Contract
A client order constitutes a binding offer, which I may accept by written confirmation (email sufficient) or by beginning work. Preliminary cost estimates or proposals are non-binding. All drafts, sketches, or documents provided during the offer phase remain my property and may not be shared with third parties without my consent.
§3 Rights of Use
After full payment, the client receives the agreed rights of use for the delivered work results. Unless otherwise agreed, these rights are exclusive, transferable, and unlimited in time and territory. The client may adapt and further develop the works, including transfer to third parties.
§4 Prices and Payment
Fees are based on the contract or agreed estimate. Invoices are payable within 14 days of delivery without deduction, unless otherwise agreed. Part payments or advances may be requested for project phases.
§5 Deadlines
Agreed deadlines are binding only if confirmed in writing. In cases of force majeure (e.g. illness, strikes, technical failures), deadlines are extended accordingly.
§6 Warranty and Liability
If defects arise, I will provide remedy by correction or redelivery. For damages, I am liable without limitation in cases of intent or gross negligence, and for injury to life, body, or health. For breaches of essential contractual duties (cardinal obligations), I am liable also for slight negligence, limited to foreseeable damages. Further liability is excluded, except where legally mandatory.
§7 Applicable Law & Jurisdiction
German law applies. If the client is a merchant or legal entity under public law, jurisdiction is at my place of business.
